What to verify before hiring a painter: guarantees and contract

Hiring a painter for your home is a decision that goes beyond choosing wall colours. The outcome depends on both professional technique and the formality of the agreement, and taking basic precautions from the start saves you from surprises, disputes, and unexpected costs later on. In Spain, there are clear rules that protect consumers when renovating their homes, but they only work if you know what to ask for and what to verify before signing anything.

Confirm the professional is registered as self-employed or as a company

The first step is to verify that whoever is going to paint your home operates legally. A self-employed professional in Spain must be registered with Social Security (under RETA, the Special Regime for Self-Employed Workers) and with the Tax Agency, which guarantees compliance with tax and labour obligations.

Demand a written quote with all work details

The consumer has the right to request a prior written quote, which serves as a work order. This quote must clearly identify the professional or company (name, address, tax ID, telephone), describe the surfaces to be painted, indicate the number of coats, the type of finish, necessary preparation (sanding, filling, priming) and the total price, including materials and labour.

When the quote is calculated per square metre, be clear that this price is always indicative and provisional. Two surfaces with the same area can be in very different conditions: a wall with cracks, damp, or old paint layers requires much more work than a new surface. This is why the final price can only be confirmed after assessing the actual condition of the walls.

Ensure the scope of work is documented in writing and visible to all three parties

The Building Code distinguishes several periods: one year if damage appears as a result of a defect in the painting, tiling or coating1. The deadline to claim from the painter is one year for defects detected in paint finishes and coatings. Additionally, the Consumer Protection Act establishes six months' guarantee on the provision of services.

To be able to claim within these periods, it is essential to have the legal invoice for the work, with the date, the name of the company or self-employed person (with their tax address and ID) and a description of the service provided. Without a legal invoice, the chances of a successful claim are drastically reduced.

Some companies and painters offer additional guarantees (for example, twelve or twenty-four months instead of six) that can be included in the contract. These extended guarantees must specify what they cover and for how long, and do not eliminate minimum legal guarantees, which are non-negotiable.

Verify references and reputation before deciding

Beyond the paperwork, it is worth checking the professional's track record. Look for reviews from previous clients, ask in your circle if anyone has hired them before, check ratings on digital platforms. A painter with a good recent history and durable work over time is a positive sign.

If you are comparing several quotes, do not focus only on the lowest price: also compare the materials included, the scope of prior preparation, execution timelines and guarantee conditions. A cheap quote may hide that essential work is missing or that the paint quality is inferior.

Before accepting a quote or signing a painting contract in Spain, make sure these minimum requirements are met:

• Post-work guarantees are documented in writing (minimum legal guarantee of six months or one year depending on applicable law, or extended guarantee if applicable).
• You will receive a legal invoice with all tax details upon completion of the work.

With these simple checks you drastically reduce the risk of problems, ensure that the agreement is fair for both parties and protect yourself against any future issues.
